Though a judge dismissed several allegations over numerous passages in Mariah Carey‘s best-selling memoir, ‘The Meaning of Mariah Carey,’ that her brother, Morgan Carey, deemed disparaging, the Pop icon is still set to go to court to defend two sections of the book in which she suggested he sold drugs and ‘had been in the system.’

On Tuesday (February 15), a New York judge ruled Morgan could move forward with a defamation lawsuit against his legendary sister over her claims he distributed cocaine and served prison time.

“Although Carey maintains that the phrase ‘sometimes drug dealing’ is a ‘rhetorical epithet,’ in light of the earlier statement that plaintiff had supplied clubgoers with ‘powdered party favors,’ the average reader could understand this phrase to mean that plaintiff had committed a serious crime,” Justice Barbara Jaffe wrote in her decision

An attorney for Mr. Carey said he was “pleased” with the judge’s decision while, at writing, a rep for Carey hasn’t issued a statement.

Although Jaffe is allowing Morgan to move forward with his suit on the basis of two of the book’s passages, he originally filed it in March 2021 based on eight passages he called “malicious falsehoods.” From claims he abused their mother, got into a fight with their father, had sketchy contacts in the music industry, and more, Mariah painted a picture of her brother in ‘The Meaning of Mariah Carey’ the he says was ‘painful’ and caused ‘serious damage to his reputation.’

Once Morgan refiles his case based on the two potentially defamatory passages, the case will proceed to trial – assuming there is no out of court settlement – on those allegations alone.
