Nearly 8 months after first learning he was the subject of a lawsuit stemming from a leaked sex tape, a federal judge recently gave funnyman Kevin Hart a reason to smile.

As reported here in September 2019, Montia Sabbag – a woman who claims Hart conspired with a friend to secretly record their sexual encounter on film – sued him for a whopping $60 million for “intentional infliction of emotional distress and invasion of privacy.”
Now, after multiple attempts to get the case dismissed, a federal judge in California has sided with the comedy superstar’s request citing its filing was made at the ‘wrong venue.’
“Court finds that Plaintiff is domiciled in California. Because Plaintiff and defendants Kevin Hart and Jonathan Todd Jackson are all California citizens, there is no complete diversity of all parties in this action. The Court therefore lacks federal subject matter jurisdiction over Plaintiff’s claims,” the order reads.
