Halle Berry is facing serious allegations amid an escalating custody battle with ex-husband Olivier Martinez.

On Thursday, a Los Angeles judge granted Martinez a temporary restraining order after he accused the actress of physically abusing their 12-year-old son, Maceo.

Martinez filed an emergency petition alleging that an incident took place on September 26.

According to the filing, he claims Berry jumped on Maceo before placing her hands around his neck and choking him. Martinez alleges that she shouted, “Who is dominant now?”

He also cited alleged incidents spanning the past 18 months, including a claim that Berry wrestled their son to the ground and forced him to “tap out.”

The temporary order requires Berry to remain 100 yards away from Martinez. Her visitation with Maceo has also been limited to two days a week and every other weekend.

A hearing is scheduled for October 16, while both parents have been ordered to participate in confidential mediation.

Berry’s attorney, Marina Beck, strongly denied the allegations, saying:

“To say this filing is entirely meritless and deliberately misleading would be an understatement. There is voluminous evidence, including numerous judicial rulings, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry’s minor son Maceo.”

Beck added that the filing was “not entirely unexpected,” pointing to what she described as Martinez’s “well-documented history of erratic, possessive, and violent behaviour.”

Martinez is seeking sole custody of Maceo.

The former couple married in 2013 and finalized their divorce in 2023.
