The power couple will soon be back in the courtroom as they continue pursuing punitive damages that could total as much as $53 million. While T.I. and Tiny were awarded $17.1 million in the September verdict, the punitive damages portion of the case remains unresolved.
MGA Entertainment argues that the term “OMG” is generic and that the ‘OMG Girlz’ had no connection to the name, image, or likeness of the toy line in question.
MGA attorney Mark Finkelstein argued:
“How can a generic term for which there can be no liability in a trademark context now be a basis for punitive damages? And there is no evidence that OMG was selected based on the OMG Girlz.”
The judge wasn’t convinced by that argument, which is why the issue is now heading back to trial. The new proceedings are scheduled to begin on June 23 and are expected to last just three days, with the focus solely on determining punitive damages.
For T.I. and Tiny, the fight isn’t over yet, and it’s clear they’re looking to collect every dollar they believe they’re owed.
