It’s celebration time in the Carter household this week.
Fresh from pulling off a successful TIDAL charity fundraiser, both Jay Z and Beyonce have scored major wins in the courtroom over the last two days.
As reported, a federal judge ruled in favor Queen Bey by dismissing a bogus lawsuit levied against her and her song ‘XO.’
Now, media mogul Jay is able to rejoice after her landed a similar win in regard to his hit ‘Big Pimpin”
Details below…
As previously reported, the rapper was accused of using Egyptian composer, Baligh Hamdi‘s 1957 track ‘Khosara Khosara‘s Arabic melodies in his 1999 hit.
However, the US district judge Christina Snyder dismissed the lawsuit against the 45-year-old and producer Timbaland before it went to a jury at a federal court in Los Angeles. She ruled that the heir of an Egyptian composer lacked the right to pursue a copyright infringement claim.
Osama Fahmy, nephew of Hamdi, filed the lawsuit against the singer claiming that the singer and his producer didn’t have the late Egyptian composer’s permission to sample the song’s flute notes.
Ultimately, Fahmy lacked standing to pursue his claim, so, it was not necessary to submit to the jury whether ‘Pimpin’ infringed ‘Khosara Khosara’. {Source}

Interesting. Very much so.
Essentially, a technicality meant the alleged evidence was never presented to the jury and the case was dismissed accordingly. A quite different predicament to that of Beyonce, whose case did consider the evidence and was dismissed based on it.
Nonetheless, check out the clips below and let us know what the TGJ jury think…
YAAASSSS DONT FUXK WITH THE MOST POWERFUL COUPLE IN MUSIC!!! GET YO MONEY AND SETTLE YO CASES MR AND MRS CARTER!!! POWER TO YA!!!!
Timbaland used the sample without permission. Point blank.
Actually this song is credited in Jay’s album.
That’s good 4 Jay, but you’d have 2 b deaf n both ears if u can’t hear the similarities between the tracks. No shade, bc we like Jay.
Good for him, I guess he knows how to get around such case cus as much as I love the him, I will be admitting that my Ear is not functioning if I don’t admit that Jay_Z used the song sample without permission. That being said… congrats and also to my QueenBey.
I read further and learned that Timbaland paid EMI Saudi Arabia $100k to acquire the license once he learned the original piece wasn’t license free. (I have no idea why he thought it would be license free.) The nephew bringing the suit wanted an additional payment based on “moral law” from Egypt, which did not apply in the United Sates, the specific cause being that Jay and Timb didn’t seek the permission of the composer’s family before using the track. The similarity of the melodies wasn’t the main issue the defense wanted to litigate.
Thank You!!!! I was going comment this earlier. The haters always are quick to voice their biased opinions, without even doing the proper research. The case wasn’t about how similar the songs sounded. That much was as clear as day.
That’s good.
